TuneBull respects the intellectual property rights of others and expects users of the TuneBull platform to do the same.

This DMCA Copyright Policy explains how TuneBull handles claims of copyright infringement involving content uploaded, posted, submitted, transmitted, or otherwise made available by users of the TuneBull platform.
This Policy applies to content available through TuneBull, including music, sound recordings, compositions, beats, audio files, images, artwork, videos, posts, profile content, and other user-generated content.
1. User Responsibility for Content
TuneBull allows users to upload, post, submit, and share content, including music.
Users are responsible for ensuring that they have all rights, licenses, permissions, consents, and authorizations necessary for content they make available through TuneBull.
Users may not upload or make available content that infringes the copyrights or other intellectual property rights of another person or entity.
For music, users are responsible for having the rights and permissions necessary for the applicable sound recording and underlying musical composition, as well as any third-party material incorporated into their content, including samples, beats, loops, artwork, photographs, and other protected material.
TuneBull may remove or disable access to content that infringes or is alleged to infringe copyright in accordance with applicable law and this Policy.

TuneBull's service provider, Stay On Beat, LLC, has designated an agent with the United States Copyright Office to receive notifications of claimed copyright infringement.

3. How to Submit a DMCA Takedown Notice
If you are a copyright owner, or are authorized to act on behalf of a copyright owner, and believe that material available through TuneBull infringes an applicable copyright, you may submit a written notification of claimed infringement to TuneBull's Designated DMCA Agent.
To be effective under the DMCA, your notification should include substantially the following information:
A. Signature
A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
B. Identification of the Copyrighted Work
Identification of the copyrighted work claimed to have been infringed.
If multiple copyrighted works on TuneBull are covered by a single notification, you may provide a representative list of those works.
C. Identification of the Allegedly Infringing Material
Identification of the material that you claim is infringing or is the subject of infringing activity and that you request TuneBull remove or disable access to.
You must provide information reasonably sufficient to allow TuneBull to locate the material.
Whenever possible, please provide the exact TuneBull URL where the allegedly infringing material appears.
For music, it is helpful to provide information such as:
- Song title;
- Artist name;
- TuneBull username or profile;
- Exact TuneBull song or post URL;
- ISRC, if applicable and known; and
- Any other information that will help TuneBull identify the reported material.
D. Your Contact Information
Provide information reasonably sufficient for TuneBull to contact you, such as:
- Your full name;
- Mailing address;
- Telephone number; and
- Email address.
E. Good-Faith Statement
Include a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner's agent, or the law.
F. Accuracy and Authority Statement
Include a statement that the information contained in your notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. What Happens After TuneBull Receives a DMCA Notice
Upon receiving a notification of claimed copyright infringement, TuneBull may review the notice to determine whether it substantially satisfies applicable DMCA requirements.
When appropriate, TuneBull may act expeditiously to remove or disable access to material claimed to be infringing.
TuneBull may also take reasonable steps to notify the user who uploaded or made the affected material available.
TuneBull may preserve records relating to the reported material, the notice, the affected account, and TuneBull's response for legitimate legal, compliance, security, fraud-prevention, and dispute-resolution purposes.
Removal or disabling of material in response to a copyright notice does not necessarily constitute a determination by TuneBull that copyright infringement occurred.
5. Counter-Notification
If your content has been removed or disabled as a result of a DMCA notification and you believe that the material was removed or disabled because of mistake or misidentification, you may submit a written counter-notification to TuneBull's Designated DMCA Agent.
A counter-notification must include substantially the following:
A. Your Signature
Your physical or electronic signature.
B. Identification of Removed Material
Identification of the material that was removed or to which access was disabled and the location where the material appeared before it was removed or disabled.
Whenever possible, provide the previous TuneBull URL.
C. Statement Under Penalty of Perjury
A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
D. Your Contact Information and Consent to Jurisdiction
Your:
- Full legal name;
- Address;
- Telephone number; and
- Email address.
Your counter-notification must also include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located.
If your address is outside the United States, you must consent to the jurisdiction of a Federal District Court in any judicial district in which the service provider may be found.
You must also state that you will accept service of process from the person who submitted the original DMCA notification or an agent of that person.

6. What Happens After a Valid Counter-Notification
When TuneBull receives an effective counter-notification, TuneBull may provide a copy of the counter-notification to the person who submitted the original copyright notice.
TuneBull may inform that person that TuneBull intends to replace the removed material or cease disabling access to it in accordance with the DMCA.
Subject to the requirements of applicable law, TuneBull may restore the material not less than 10 and not more than 14 business days after receiving the counter-notification unless TuneBull's Designated DMCA Agent first receives notice that the person who submitted the original notification has filed an action seeking a court order to restrain the user from engaging in the allegedly infringing activity.
7. Repeat Infringer Policy
TuneBull maintains a policy providing for termination, in appropriate circumstances, of users who are repeat copyright infringers.
TuneBull may maintain records of copyright notices, removals, account actions, counter-notifications, and other relevant copyright enforcement activity.
When determining whether account restriction or termination is appropriate, TuneBull may consider relevant circumstances, including the nature and number of copyright complaints associated with an account, the disposition of notices and counter-notifications, and other relevant information.
TuneBull reserves the right to suspend, restrict, or terminate accounts in appropriate circumstances in accordance with this Policy, TuneBull's Terms of Service, and applicable law.
8. Fraudulent or Misleading DMCA Submissions
DMCA notices and counter-notifications are legal communications.
Knowingly materially misrepresenting that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may result in liability under applicable law.
Do not submit false, fraudulent, abusive, or intentionally misleading copyright notices or counter-notifications.
9. Content Removed for Other Reasons
This DMCA counter-notification procedure applies to material removed or disabled as a result of qualifying copyright infringement claims.
Content may also be removed or restricted for reasons unrelated to copyright, including violations of TuneBull's Terms of Service, Community Guidelines, security policies, fraud rules, or other applicable policies.
Submitting a DMCA counter-notification does not require TuneBull to restore content that independently violates another TuneBull policy.
10. No General Monitoring Obligation
TuneBull may use moderation, reporting, security, fraud-prevention, and content-management systems as part of operating the Service.
Nothing in this Policy should be interpreted as a representation that TuneBull monitors every song, audio file, image, post, profile, or other item of User Content before it becomes available through the Service.
Users remain responsible for ensuring that their User Content complies with applicable law and TuneBull's Terms of Service.
11. Changes to This Policy
TuneBull may update this DMCA Copyright Policy from time to time to reflect changes to the Service, TuneBull's procedures, or applicable law.
The current version will be made available through TuneBull and will display its most recent update date.
TuneBull will maintain current Designated Agent information as required by applicable law.
